Right To Manage

The Commonhold and Leasehold Reform Act 2002 gives leaseholders the statutory right to effectively take over the management of their properties by forming a Right to Manage Company (RTM).

As long as 50% of residents within your building are in agreement you will have the right to take over the management from your freeholder or replace a poor management company. You do not need your landlords’ permission to exercise your right to manage, although you will need to meet qualifying rules set out within the Act. Pepper Fox will visit your property in the first instance to determine whether your building meets the relevant criteria.

Collective Enfranchisement

Collective Enfranchisement allows you to purchase the Freehold of the block collectively between a number of the lessees. The 1993 Leasehold Reform Act (as amended) provides the right for at least 50% of 'qualifying' leaseholders to compel the Landlord to sell the Freehold to them.

Pepper Fox are able to engage legal representation to act on your behalf in respect of obtaining a specialist Valuer's opinion and to prepare & serve the Notice of Claim upon your Landlord. Your dedicated legal representative(s) will be able to search for 'absent Landlords', assist with Vesting Order applications and negotiate with the Crown where appropriate.
